Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tanky website at tanky.com.au (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. Please read them carefully. If you don't agree, please don't use the Site.

1. Who we are

The Site and store are operated by Tanky ("Tanky", "we", "us", "our"), of b2/13 Endeavour Road, Caringbah NSW 2229, Australia. You can contact us at hello@tanky.com.au or on 0404 353 333.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to buy from us. By placing an order you confirm you meet this requirement and that the information you provide is accurate and complete.

3. Our products

Tanky sells portable kegerators and related drink systems and accessories, including CO₂ cartridges. Our products use pressurised CO₂ and are intended for use strictly in accordance with the instructions and safety guidance provided.

4. Pricing & currency

Prices are listed in Australian Dollars (AUD) by default and may be displayed in your local currency (USD or NZD) based on your location. Prices, product specifications, promotions and availability may change at any time without notice.

5. Orders & acceptance

When you place an order you make an offer to buy. Our order confirmation email acknowledges that we've received your order, but it does not constitute acceptance; a contract is formed only when we dispatch your order. We reserve the right to limit quantities and to refuse or cancel any order — including after an order is placed and for reasons including suspected fraud, pricing or stock errors — in which case we'll notify you and refund any payment in full.

6. Payment

Payment is processed securely through our payment providers, including Shopify Payments and the other gateways shown at checkout. You confirm you are authorised to use the payment method you provide. We do not store your full card details.

7. Shipping, returns & warranty

Delivery is governed by our Shipping & Delivery policy, and returns, refunds and warranty by our Returns, Refunds & Warranty policy. Both are incorporated into these Terms by reference.

8. Product use & safety

Our products use pressurised CO₂ cartridges. You agree to: follow all product instructions and safety guidance; use only compatible 16g threaded CO₂ cartridges; not expose products to excessive heat or tamper with pressurised components; and keep products away from young children. To the extent permitted by law, we are not liable for loss, damage or injury resulting from misuse, modification, or failure to follow the instructions.

9. Intellectual property

All content on the Site — including the Tanky name, logo, text, graphics, images, video and product designs — is owned by or licensed to Tanky and protected by intellectual property laws. You may not copy, reproduce, distribute or use it for commercial purposes without our prior written permission.

10. Reviews, feedback & user content

If you submit a review, photo, comment or other content, you grant Tanky a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business. You confirm the content is yours to share and doesn't infringe any third party's rights. We may remove content at our discretion.

11. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to attempt unauthorised access, or to submit false or misleading information.

12. Third-party links & services

The Site may link to or rely on third-party services (such as payment, analytics, reviews and shipping providers). We're not responsible for the content, policies or practices of third-party sites and services.

13. Disclaimers

The Site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, and except for guarantees that cannot be excluded under the Australian Consumer Law, we make no warranties that the Site will be uninterrupted, secure or error-free.

14. Limitation of liability

To the maximum extent permitted by law, Tanky will not be liable for any indirect, incidental, special or consequential loss arising from your use of the Site or our products. Where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the goods or paying the cost of resupply. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

15. Indemnity

You agree to indemnify Tanky against any claim, loss, damage or cost arising from your breach of these Terms or your misuse of our products.

16. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we handle your personal information.

17. Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

18. Changes

We may update these Terms from time to time. The version published on the Site at the time of your order applies to that order. Your continued use of the Site means you accept the current Terms.
